Adoption in India
The adoption process in India is undertaken with a great care and a standard procedure is followed to regularize it. The government has taken these initiatives to stop child trafficking. Therefore, several precautionary measures are taken by the government. Government is taking all the initiatives to save child rights. In country like India, an Indian, non-resident Indian or any foreign national is allowed to adopt. There are specific guidelines and documentation required to adopt a child, a married couple or a single female can adopt a child. A single male can adopt a child under the special norms only for this he needs to apply through the registered agency.
Conditions applicable to adopt a child are as follows:
- The basic condition to adopt a child is the parents should be mentally sound and financially able to take care for a child.
- The person who wished to adopt a child should be 21 years of age the maximum age factor of the parents varies from agency to agency.
- Under the special conditions if the age of the child is more than the parent's age may be relaxed accordingly.
- For the children who have some sort of disability and needs a special treatment the age limit relaxed marginally by the state government, depending on the evaluation of the case.
Adoption as per the religion: Indian citizens who are Hindus, Sikhs, Jains, or Buddhists are allowed to formally adopt a child as per the religious law. The adoption is under the Hindu Adoption act as per this act parents are not allowed to adopt more than one child of the same gender. Non-resident Indians, foreign citizens and those Indian nationals who are Christians, Jews, Parsis and Muslims are subjected to the guardian and wards act of 1890 as per this act the adoptive parent is only the guardian of the child until she reaches 18 years of age.
